End User License Agreement (EULA)

1. License Grant and Ownership
OpenSS is licensed, not sold. Subject to your compliance with this EULA, Southbytelabs LTD grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the OpenSS application on macOS devices that you own or control. All rights not expressly granted to you are reserved by Southbytelabs LTD.
2. Permitted Use (Personal and Commercial)
You may use OpenSS for personal, professional, or commercial purposes. However, you are solely responsible for ensuring that your use of the software complies with all rules, policies, and terms of service of any external organization or platform with which you interact, including but not limited to professional environments, video conferencing platforms, and online meeting hosts.
3. Account, Subscriptions, and Service tiers
Your access to OpenSS-hosted services (including hosted AI inference) is governed by your subscription tier:
- Free Tier: Entitles you to a limited number of hosted AI units per billing month, subject to anti-abuse and rate limits.
- Pro Tier: Entitles you to a higher quota of hosted AI units and access to advanced hosted-model capabilities.
4. Hosted AI Services & Optional CLI BYOK
OpenSS allows you to route requests through our hosted proxy servers or, in supported Terminal CLI workflows, directly to third-party AI models (for example OpenAI or Anthropic) using your own API credentials. When using CLI BYOK features, you agree to comply with the terms and conditions of your respective third-party providers. We do not inspect, log, or store your private API keys.
5. Restrictions
Except as expressly permitted by applicable law, you may not:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the OpenSS desktop application or its bundled engine
- Copy, modify, adapt, translate, or create derivative works of the software
- Sublicense, lease, rent, sell, redistribute, or commercially exploit the software
- Bypass, disable, or circumvent any copy protection, usage limits, or digital rights management mechanisms implemented in the software
- Use the software's name, logos, or trademarks to represent unofficial builds or derivative products
6. Intellectual Property
Southbytelabs LTD retains all right, title, and interest in and to the OpenSS desktop application, the bundled Python engine, website, code assets, and any associated branding or design tokens. Third-party packages, libraries, or sidecar dependencies bundled with OpenSS remain subject to their respective open-source or permissive licenses.
7. Software Updates
Southbytelabs LTD may from time to time provide updates, patches, bug fixes, or new versions of OpenSS. These updates may download and install automatically, or require manual user prompt. By using the software, you consent to receive such updates and agree that this EULA will apply to all future updates unless accompanied by a separate license.
8. Suspensions and Termination
We reserve the right to suspend or terminate your license to use the software and access our hosted services at any time, with or without cause, including if we determine that your usage violates acceptable use guidelines, exceeds rate limits, or constitutes abuse. Upon termination, you must cease all use of OpenSS and uninstall it from your devices.
9. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED “AS IS” AND WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOUTHBYTELABS LTD DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL OPERATE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of Liability
IN NO EVENT SHALL SOUTHBYTELABS LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SOFTWARE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
11. Governing Law
This EULA shall be governed by, and construed in accordance with, the laws of the jurisdiction in which Southbytelabs LTD is incorporated, without regard to conflict of law principles.
12. Historical Licensing Wording
OpenSS versions released under an earlier license (prior to version 0.1.9) remain subject to the license that accompanied those versions. OpenSS 0.1.9 and later are distributed under the OpenSS End User License Agreement.
